Terms of Service

By accessing or using the NearbyMe website or app (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

NearbyMe connects customers in Warri, Delta State with local restaurants, shops, and independent riders for the ordering and delivery of food, groceries, and everyday essentials. NearbyMe acts as an intermediary platform and is not itself a restaurant, grocer, or delivery company.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders on NearbyMe.

Prices, availability, and delivery times shown on the Service are provided by individual restaurant and shop partners and may change without notice. NearbyMe is not responsible for pricing or menu errors made by partners.

Payment for orders is made online at checkout by card, USSD, or bank transfer, processed securely through our third-party payment provider. NearbyMe does not accept cash or card payments on delivery. You are responsible for ensuring your payment details are accurate and that sufficient funds are available.

Each order is assigned a unique delivery code. You must provide this code to your rider to confirm receipt of your order. NearbyMe is not liable for orders released without a valid code confirmation where the customer failed to provide one on request.

You agree not to misuse the Service, including submitting false information, abusing the rider or partner application forms, or attempting to interfere with the normal operation of the Service.

To the fullest extent permitted by law, NearbyMe is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of profits, data, or goodwill. NearbyMe’s total liability for any claim arising from these Terms or the Service is limited to the amount you paid for the order giving rise to the claim. NearbyMe is not responsible for the quality, safety, or legality of items sold by restaurant and shop partners, or for the acts or omissions of independent riders.

NearbyMe may suspend or terminate access to the Service for any account found to be in breach of these Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
